This is the sales policy that CREATION & SAVOIR FAIRE S.L. (Trade mark Touch By) applies to its sales in a general sense, except in the given case where a previously established accord is reached with the professional. By confirming a purchase, all customers’ implicitly accept and are subject to the following sale conditions.

Price lists will be sent by e-mail. Touch By reserves the right to modify said price list without prior notice. Nonetheless, invoices will reflect prices that are in effect on the date when the purchase order is confirmed. Prices are usually established for a period of about one year, starting from January 1st of each year.
Prices do not include packing, mounting, installation or transportation; nor do they include applicable sales taxes. A 18% sales tax (IVA) will be applied to sales within the entirety of the Spanish territory, with the exception of the Canary Islands (IGIC). In the case of all other countries, the corresponding tax regime will be applied.
Placing an Order
In order to avoid mistakes or possible confusions, all orders must be received by e-mail, complete with the following:
1. Full contact information: Company name, commercial name, NIF, CIF or tax identification number, invoice address, delivery address, telephone, fax, e-mail, and the name of the contact person.
2. Product reference.
3. Quantity requested.
Once the purchase order has been received, a pro forma invoice will be sent by e-mail, containing our complete bank information for corresponding deposits and transfers. (Please refer to the PAYMENT section for more information).
Touch By will confirm the order by returning a signed copy of the pro forma invoice or estimate, which will come into effect EXCLUSIVELY after the down payment. Delivery times will be effective after confirmation of a down payment of 40%.
Delivery and Freight
The indicated delivery times correspond to the average processing time for each order in addition to the time it takes to deliver the goods.
Whenever the requested products are in stock, goods will be delivered to the freight handler within a period of time no longer than 3 working days, with complete delivery to the customer no longer than 15 working days, with the exception of certain geographic regions.
For all goods not in stock, deliveries will be made in a period of time no longer than 6 weeks after confirmation, with the exception of limitations caused by inconceivable factors. In said case, Touch By will inform its customers about the delay as soon as possible.
Goods will be delivered with the corresponding freight costs established on the invoice.
Freight is handled by way of Touch By accustomed freight handler, or by the freight handler specifically indicated by the client. In this case we request complete information for the selected freight handler.
All deliveries are of strict commercial character. Please consult our customer services team for all other delivery methods.
Freight costs vary according to each products weight, type of delivery, urgency to be delivered, and geographic region. One can consult said freight costs for each specific case with our customer services team.
Deliveries will be considered completed once the goods requested are turned over to the freight handler with proper packaging, previous verification, and all necessary documentation needed by the freight handler, who will in turn take them to the address indicated by the customer.
Creation & Savoir Faire S.L. assumes no responsibility for risk of loss or damage to the products once the goods have been delivered and the packing list has been signed by the customer accepting the goods.
In case of none conformity, the customer must sign the packing list as “pending revision” and notify Touch By in written form about the inconformity within 24 hours of reception.
In case this process is not followed, Touch By is NOT responsible for any later claims.

Property
All goods are property of Creation & Savoir Faire S.L. until they have been fully paid for by the customer. Touch By reserves the rights to intellectual property of all designs as well as that of the designers represented.
Methods of payment
In case of ready stock, orders must be fully paid for prior to delivery.
In case of lack of stock, payment must be made by means of an initial deposit of 40% after confirmation of the purchase order and the remaining 60% before delivery.
Payment can be made in cash directly to the freight handler with a 5% handling fee, or before the goods are delivered by means of a bank transfer or via a direct deposit to our Creation & Savoir Faire S.L. bank account while at the same time sending the corresponding bank slip by e-mail at accounts@touchby.com.
Touch By reserves all rights over the goods and will not proceed to make any deliveries until the requested deposit has been made by the customer and can be verified by the pertinent bank authority.
All optional methods or conditions for payment must be discussed and accorded with our customer services team depending on each specific case (company history, volume, contracts).
Bank commissions are the customer’s responsibility.
An extra 6% will be added to the purchase order’s total (before freight and taxes) to cover extra costs for packing upon customer request.
Warranty
All products have one year warranty, beginning with the date on the corresponding invoice, with the exception in which Touch By specifically stipulates differently.
The document that credits this warranty on behalf of Touch By is the invoice, making this document absolutely necessary for any claim.
Claims relating to defects or imperfections in terms of variations to colour or texture on natural materials (wood, leather) will not be accepted as they are the result of hand made manufacturing that aim to accentuate their natural beauty.
The warranty becomes void if any of the goods have been altered.
Once 24 hours have passed from the delivery of the goods and the acceptance of the packing list, without any complaints from the customer for damages or defects to the products, it will be understood that the delivery has been made to the customer’s complete satisfaction and according to each case, applications of art.336 and art. 342 of the CCO will come in effect.
For any legal action that may emerge from the sale of our products, all parts are subject to the jurisdiction of the Madrid (Spain) Tribunals.
Returns
In the given case where a customer should receive a product they did not request, if in fact the error has been due to faults caused by Touch By , the incident must be communicated in written form to our customer services department, in a period no longer than 4 days after final delivery of the goods. The customer must preserve the products as they were originally packed and ensure the correct protection of the goods so as to avoid damaging them, attaching all documents. Freight costs will be covered by Creation & Savoir Faire S.L.
In case of returns being made whose fault can be attributed to the customer, the customer must contact our customer services department in a period no longer than 4 days after delivery, and return them to our Touch By head offices in Madrid (Spain), unaltered, attaching a copy of the sales invoice, and in the original packaging, with all freight charges due fully paid for by the customer.
Under no circumstance are returns accepted in the case of custom ordered goods. The down payment will not be reimbursed.
